The impact of intellectual property on the European Union economy

The EPO (European Patent Office) and EUIPO (European Union Industrial Property Office) have studied the impact of intellectual property on the economy of the European Union and EFTA countries (Switzerland, Iceland, and Norway) as well as the United Kingdom during 2017/2019. The study defines IPR (Intellectual Property Rights)-intensive industries in the EU economy (i.e., as those having an above-average ownershop of IPRs per employee, as compared with other IPR-using industries), which include manufacturing, technology, and business services. There are 357 high IPR-intensive industries, 4 more than in 2019 for the previous study with two-thirds using IPR heavily and the report’s […]

Password: update your reflexes!

The CNIL has just issued a new recommendation to control the security of passwords, taking into account the evolution of knowledge and attacks in this area. This update was necessary, given the increased threats to data security and the clear finding of a study conducted by Verizon in 2021, which revealed that more than 80% of global data breach notifications are related to password issues. But what are the risks associated with poor password management? There are four factors to consider: The simplicity of the password, The listening on the network in order to collect the transmitted passwords, Keeping the […]

The Haka, a timeless cultural heritage

Is the end of the untimely use of the Haka in sight? Everyone knows the Haka, the Maori war dance popularised by the New Zealand rugby team, the All-Blacks, who perform it at the start of every match. This war dance was invented in the early 1800s by Te Rauparaha, chief of the Ngati Toa tribe, and his heritage is now perpetuated and defended by the Ngati Toadit. In New Zealand, the Haka is truly part of the nation’s cultural heritage, which notably led to the adoption in 2014 of specific legislation to protect the Haka Ka Mate, the “Haka […]

Copyright protection for works created by artificial intelligence

Alan Jay PERLIS, a computer specialist, stated in 1982 that “in man-machine symbiosis, it is man who must adjust: The machines can’t.“. This statement is particularly true today. Indeed, with the development of artificial intelligence, the latter is now capable of generating creations in an almost autonomous way in many fields. We can therefore legitimately ask ourselves whether these creations are eligible to protection by copyright. However, in the current state of copyright law and doctrine, the creator is necessarily a physical person, and this despite the fact that this rule is not expressly stated in the legal texts. Indeed, […]

IP BOX : the INPI Lyon’s morning sessions

As part of its program of “Intellectual Property” mornings, the INPI delegation in Lyon, in partnership with the Compagnie des Conseils en Propriété Industrielle (CNCPI) and the Lyon Bar, organized a training session dedicated to the operation of the so-called “IP Box” regime, a tax system favorable to the exploitation of industrial property assets resulting from a company’s R&D work. A more precise focus was planned on its application to original software, a new feature of the 2019 finance law that has been somewhat overlooked until now. Entirely dematerialized from Lyon, this conference on the IP Box and its consequences […]

Together against counterfeiting!

From December 2020 to September 2022, after months of investigation, French Customs initiated and coordinated one of the largest operations ever conducted at the European level against counterfeiting sold on the Internet, in coordination with Europol, DNRED (National Direction of Intelligence and Customs Investigations) and the German, Spanish, Italian, Polish, Czech and British law enforcement agencies. Result: This operation allowed the seizure or blocking, in these 7 countries, of 16.7 million counterfeit products, mainly toys, and mostly coming from China. Hundreds of thousands of online buyers have been – most of the time – deceived by the advertisements of these […]

Manolo Blahnik can (finally) settle in China

After 22 years of legal proceedings to get his name back, Manolo Blahnik, the UK-based luxury shoe designer, will (finally) be able to market his products in China. The case dates back to 1999, when a Chinese businessman registered the trademark “Manolo & Blahnik” in China before the luxury designer. However, Chinese legislation applies the “first to file” system (first-come, first-served) to trademarks. This system allows “pirates” (companies or individuals) to obtain exploitation rights on a name, without any real intention to exercise them. These “pirate” registrations can then be resold, usually at high prices, to foreign companies wishing to […]

Use your trademark to avoid its revocation

Use your trademark to avoid the risk of revocation and keep proof of it A Trademark allows to obtain a monopoly of exploitation on a sign in connection with the goods or services referred to in the application for registration. However, it is a living legal title, linked to commercial development over time and whose force and enforceability weaken if it is not or no longer used for all or part of the protected goods and services. In France and in most European countries, the absolute protection ends 5 years after the registration of the trademark.   The legal news […]

When brands surf on the fame of Queen Elizabeth II

The recent death of Queen Elizabeth II has certainly not escaped you. The British are mourning their Queen, but the whole world is joining in their sadness, as the Queen of England was so iconic and famous far beyond her borders. During the 70 years of her reign, we could see Elizabeth II’s face on stamps, coins, banknotes, on television, but also on Andy Warhol’s paintings, the cover of the Sex Pistols’ single God Save the Queen in 1977, the posters of the series THE CROWN broadcast on Netflix, countless T-shirts and even champagne capsules! If the countless goodies with […]

Lego – The ultimate leader

According to the latest ranking of favorite toy brands and licenses among 0-6 year olds, carried out by Brand Trends, the famous Danish building block mark jealously guards its position as leader in the EMEA zone (Europe, Africa, Middle East). It is ahead of Disney, Marvel and Barbie. This impressive longevity is of course due to a strong marketing strategy, but also to a well-established and long-standing intellectual property strategy. Indeed, we forget it a little quickly but for many years Lego held a monopoly on its registered designs related to its bricks and characters. Its strategy and influence in […]
