On August 3, 2024, it will be possible to extend your trademark to Qatar via the Madrid System. Qatar joined this international treaty on May 3, 2024, becoming the 115th member of the Madrid System, which comprises 131 countries worldwide: from China to the USA, from France to Finland, from Benelux to Botswana, from Estonia to Eswatini (formerly Swaziland) – let’s brush up on our geography in the process. Monaco: Before the Grand Prix, let’s talk IP!

On April 18, Nathalie FAYETTE had the pleasure of taking part in interviews with MonacoTech and Monaco Boost Starts Up, selected by WIPO. WIPO had taken the initiative of organizing a seminar on Intellectual Property in cooperation with the Permanent Mission of the Principality of Monaco in Geneva, the Monaco Economic Board and the Direction du Développement Economique, which was a resounding success. The presentation by Jean-Pierre Santos, Head of Division at the Monegasque Industrial Property Office, also provided an opportunity to discover the growing dynamism of this office, as well as the support offered by its incubators to promising […]

Tricking AI to protect your copyright

Artificial intelligences need training to create articles, images, sounds, etc., so they happily dip into existing resources – the work of journalists and artists – without their prior consent, thus blithely plundering their copyrights and financial rights. Some authors are pressing charges: In 2023, the American daily The New York Times and the Authors Guild (over 14,000 American authors and writers) against Open AI (developer of the AI ChatGPT), or three artists Sarah Andersen, Kelly McKernan and Karla Ortiz against Stable Diffusion, Midjourney and DeviantArt. And in early 2024, Midjourney was again targeted after the names of 16,000 artists it […]

World Intellectual Property Day – Innovating for a better future

#WorldIPDay In 2000, to promote a better understanding of intellectual property, WIPO member states decided that April 26, the date on which the Convention establishing WIPO came into force in 1970, should become World Intellectual Property Day. Since then, World Intellectual Property Day has provided an annual opportunity to highlight the importance of creativity and innovation worldwide. It is also an opportunity to highlight the role played by intellectual property rights in promoting these innovations, whether through patents, trademarks, designs or copyright. This year, the World Intellectual Property Organization (WIPO) is organizing an innovative video competition aimed at young people, […]

New York Times complaint and AI: a hallucinatory remake?

When it comes to errors made by artificial intelligence tools, it’s common to speak of “hallucinations“, a curious term if ever there was one, as if it were almost unrealistic for AI to make mistakes. How, then, to describe OpenAI and Microsoft’s takeover of several million articles from the respected New York Times newspaper? The complaint filed with the U.S. District Court in Manhattan refers to the damage caused by the artificial intelligence’s “hallucinations”, and calls for compensation in view of the serious damage caused to the reputation of the famous newspaper. Indeed, during this rework, which enables the development […]

Spring cleaning for Décathlon

Spring is just around the corner! While for some it heralds the return of fine weather and blossoming trees, for others it’s also a time for spring cleaning. Put away your vacuum cleaners and get out your best running shoes, because this March, Decathlon has just announced its strategic shift, with the adoption of a new logo and the dusting off of its brand portfolio. The famous sports retailer aims to strengthen its position and conquer new markets. With this in mind, the company has unveiled its new logo, consisting of a sign “as round as the world with a […]

Beware of ambush marketing!

The French Open (Roland-Garros) doesn’t start until May, and the French Tennis Federation is already recruiting a legal expert to, among other things, combat ambush marketing. This type of marketing, balanced between provocation and illegality, consists of a company associating its image with the notoriety of a major official event (often sporting: Olympics, Football World Cup…) or with a competitor’s massive advertising campaign, without authorization, without paying the rights to the event’s official sponsorship, or without paying for such a massive advertising campaign. In short: to position itself in the wake of a well-known event to benefit from the advertising […]

The popularity of non-foodstuffs Geographical Indications is growing!

Created by the Law No. 2014-344 of March 17, 2014, the Geographical Indication (GI) to protect traditional craft and manufacturing know-how is experiencing a definite craze in France! Since the first GI was approved in 2016, no fewer than 17 GIs have now been validated and 3 are in the process of being approved. As a reminder, this procedure extended the protection that existed at the time only for food and agricultural products to industrial and craft products, so that any company can promote its products and know-how, linked to its territory, and protect itself against the abusive use of geographical […]

Intellectual Property: a young lady over 5,000 years old!

As the notion of intellectual property is being abused, as some predict its demise, as OpenAi integrates it into its reflections, as taxations on streaming platforms are put in place, it is interesting to go back to its origins to rediscover its meaning and possibly its usefulness. A rare fact, this notion is shared by virtually all countries , and constitutes a common foundation for all civilizations and economic systems, however diverse they may be. The earliest traces of protection for intellectual creations date back to antiquity, when the Greeks and Romans granted a form of recognition to inventors and […]
